Maintenance
This is an essential aspect of all marriage proceedings. An application for maintenance can be filed by either spouse who lacks the adequate financial resources to support themselves. Maintenance can also be divided into two categories.
Interim Maintenance is specified during trial to ensure neither party has any disadvantages. A variety of factors are taken into account when working out the amount, the most relevant being the financial situation before the case was filed, and the salary of the party against whom maintenance is sought. The Court will aim for equilibrium between both parties.
Upon reaching a final decision, permanent maintenance can be granted either on a periodic or monthly basis depending on the specific circumstances of the case.
